4. User Responsibilities

As a user of ComplyWeb, you agree to:

  • Provide accurate and complete information when creating your account
  • Maintain the security of your account credentials
  • Only scan websites that you own or have authorization to scan
  • Use the Service in compliance with all applicable Australian laws
  • Not attempt to circumvent or disable any security features
  • Not use the Service to scan or target websites maliciously

5. Service Limitations and Disclaimers

5.1 Accuracy of Scans

While we strive for accuracy, automated accessibility scans cannot detect all WCAG violations. Manual testing and expert review are recommended for comprehensive accessibility audits. Our scans may produce false positives or miss certain issues.

5.2 No Warranty

The Service is provided "as is" and "as available" without any warranties, express or implied. We do not warrant that:

  • The Service will be uninterrupted or error-free
  • Scan results will be complete or accurate
  • Use of the Service will guarantee legal compliance
  • Defects will be corrected immediately

5.3 Limitation of Liability

To the maximum extent permitted by Australian law, ComplyWeb and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

6. Subscription and Billing

Subscription fees are charged in Australian Dollars (AUD). By subscribing to a paid plan, you agree to:

  • Provide current, complete, and accurate billing information
  • Pay all fees according to your selected subscription plan
  • Automatic renewal of your subscription unless cancelled

You may cancel your subscription at any time. Cancellations take effect at the end of the current billing period. No refunds are provided for partial months.

7. Intellectual Property

The Service, including all content, features, and functionality, is owned by ComplyWeb and is protected by Australian and international copyright, trademark, and other intellectual property laws.

You retain ownership of your website content. Scan results and reports are provided for your use but may not be redistributed or resold without permission.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. We collect and process data in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

9. Termination

We reserve the right to suspend or terminate your access to the Service:

  • For non-payment of subscription fees

Upon termination, your right to use the Service will immediately cease. You may request an export of your scan history before termination.

10. Changes to Terms

We may modify these Terms of Service at any time. We will notify you of material changes by email or through the Service. Your continued use of the Service after changes take effect constitutes acceptance of the new terms.

11. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Australian Consumer Law or any other applicable law that cannot be excluded, restricted, or modified by agreement.
